Data protection is very important to us. See what we do to keep your personal data safe.

All our front-end and back-end interfaces are 100% SSL/TLS encrypted, as well as all off-line backups in use. 

NEED TO KNOW BASIS 

Only the persons directly involved in your language test have access to your data. We do not use your contact details for advertising. 

ACCESS ONLY IN ACCORDANCE WITH FCL.1030

The provisions of EASA FCL.1030 require us to provide your licensing authority and the examiner's licensing authority with all examination details. 

We do not use your data for advertising

We need your contact details (phone / e-mail) to inform you about the result of your language proficiency test. You won't receive any advertising.

No third parties have access to your data*

Once the language proficiency examiner provides us with your data and the audio/video recordings of your test, only the LTB, the assigned examiners / linguists and the civil aviation authority* will have access. 

* we are required by law to give access to these persons / groups of persons, see below. 

No third-party software

Our testing system does not use any third-party software or plugins which require transmission of any data. Your data will be stored on our servers, located in the European Union, only.

What data do we store? 

The Language Testing Body conducts oversight, standardization and quality assurance for language proficiency tests and provides language testing materials. To perform these tasks, the language testing body needs access to:
Your name, date/place of birth, FCL license details, contact address, phone number and mail (to send the result of the test) and to the audio or video recordings of your test

Who has access to that data? 

One or more linguists and operational experts who will assign your final result. Usually, the result will be determined by your language proficiency examiner and one additional linguist. In exceptional cases (e.g. when they disagree) more raters will be assigned by the LTB.

Your Individual Rights 

  • Right to be informed 

    You have a right to be informed what kind of data we store and to know who we transmit(ted) your data to. 

    This web page will provide you with all necessary information, regarding:
    who we are
    why we process your data
    what rights you have
    which third parties also have access to your data (in our case nobody except for the competent civil aviation authorities) 
    that we store and process your data on servers located within the EU
    the data retention period (which is 7 years, as required by ZPH-FCL 7/8)
    what rights you have regarding your data

  • Right of access

    Your may exercise you right of access at any time, asking us what data we have about you or if we have any data about you at all. 

    To exercise this right, please contact us via e-mail (see contact details below, at the end of the page). Exercising this right is free of charge, once per year. Any following requests will be answered at your expense. 

    Please note: We are not allowed to provide you with the audio/video recording of the language proficiency test, since this would also include the exam questions, which are part of the protected question bank and must not be publicly accessible. In case you need access to your voice recording to get the results confirmed by a third party, please contact the civil aviation authority Austro Control GmbH to make use of your right to appeal against the language proficiency test result. 

  • Right to rectification 

    If you find out that any of the data that we have about you is wrong, you have the right to request rectification. 

    To exercise this right, please contact us via e-mail (see contact details below, at the end of the page). Exercising this right is free of charge, to set your data right. Any following requests will be handled at your expense. 

    Note: Of course, this does not apply to any wrong answers that you may gave during your language test! ;-) 

  • Right to erasure

    Please note that we are required by law: commission regulation (EU) 1178/2011 FCL.055 and FCL.1030 as well as Austro Control ZPH-FCL 7/8 to store details of all language tests for 7 years after the test was taken. Therefore you cannot request the deletion of your data.
    After that period, your personal data, including the audio/video documentation of your langauge test will be automatically deleted. We only keep pseudonymized data after that point for statistical reasons.

  • Right to restrict processing

    You do not have the right to request restriction of processing. Please note that we are required by law: commission regulation (EU) 1178/2011 FCL.055 and FCL.1030 as well as Austro Control ZPH-FCL 7/8 to store details of all language tests for 7 years after the test was taken.

  • Right to data portability

    The EU GDPR (general data protection regulation) includes a right to data portability. 

    Pleas note: Since we are not allowed to provide you with the audio/video recording of the language proficiency test, as this would also include the exam questions, which are part of the protected question bank and must not be publicly accessible, we do not have any data which allows porting. 

  • Right to object

    The EU GDPR (general data protection regulation) gives you the right to object to: 
    data processing based on legitimate interests or the performance of a task in the public interest/exercise of official authority;
    direct marketing (including profiling);
    processing for purposes of scientific/historical research and statistics.

    We do not use your data for any of the above - therefore, the right to object does not apply.
    If you do not want us to process your data, don't take a language test with us.

  • Right to revoke your initial consent to data processing

    Before taking the language proficiency test, you receive information about how long and why your data will be processed. Without processing your data, we would not be able to conduct the test at all.
    If you, at a later date, no longer agree to data processing or if you wish to revoke your initial consent to data processing, you may - at any time - inform us about this, contact us via e-mail (see contact details below, at the end of the page).

    Please note that we are required by law: commission regulation (EU) 1178/2011 FCL.055 and FCL.1030 as well as Austro Control ZPH-FCL 7/8 to store details of all language tests for 7 years after the test was taken. Therefore we have to keep your data up to that point to comply with the applicable regulations.

Who has your data, who are we? 

LevelUp works with the Language Testing Body LTB-106, wich is a branch of the Austrian company DRW Aviation Engineering, Archenwald 8, 6116 Weer, AUSTRIA, responsible for data processing, programming and test development.

Why do we process your data?

First of all, we need your data and the audio or video documentation of your language test to provide our LTB services. Furthermore, the applicable law: FCL.055, FCL.1030, ZPH-FCL 7/8 requires us to collect and store all details regarding your language test for a period of 7 years. These provisions also require us to grant access to the competent civil aviation authorities.

Can I limit the use of my data? 

No, once you decide to take this aviation language proficiency test, the current aviation laws and regulations require us to store your test details for 7 years. See above for detailed information about your rights. 

Do we transfer your data to third countries?

All data regarding your language proficiency test will be stored and processed on servers located within the European Union.

How long do we keep your data?

We will store your language test details for 7 calendar years after you took your language proficiency test. After this time, we will automatically erase all your personal data and audio/video recordings and also any backups and only keep pseudonymized details for statistical reasons.

Where do you get my data from?

Before starting your language proficiency test, you personally provide the language proficiency examiner with your data which he/she will enter into the system. The examiner will also record and upload the audio/video documentation of your exam. 

Is there any automated decision making, including profiling?

No, there isn't. 

Can I complain about the use of my data?

Yes, you can. The Austrian supervisory authority regarding data protection is the 'Datenschutzbehörde', https://www.dsb.gv.at/
